General Terms and Conditions (GTC)
§ 1 Scope
(1) These General Terms and Conditions (GTC) apply to all contracts concluded between Bluedays BV, Laanenderweg 17, 1812 PW Alkmaar, Netherlands (hereinafter "Seller") and the customer (hereinafter "Customer") via the online shop www.samakocleaning.com .
(2) The version of these GTC valid at the time of the order applies.
(3) Contracts are only concluded with consumers within the meaning of § 13 BGB.
§ 2 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order (invitatio ad offerendum).
(2) By submitting the order, the customer makes a binding offer. The confirmation of receipt of the order (order confirmation) constitutes acceptance of the offer.
§ 3 Prices and Shipping Costs
(1) All prices stated are final prices and include statutory VAT.
(2) In addition to the product prices, shipping costs apply, which will be clearly communicated to the customer before the conclusion of the order.
§ 4 Payment
The customer can make payment via PayPal, credit card (Visa, Mastercard), Klarna, or Sofortüberweisung.
§ 5 Delivery
(1) Delivery is made to the delivery address provided by the customer.
(2) The estimated delivery time is indicated on the respective product page. Unless otherwise stated, the delivery time to Germany is 3–5 working days.
§ 6 Right of Withdrawal
Withdrawal Instructions
You have the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period is 30 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (Samako Cleaning, Laanenderweg 17, 1812 PW Alkmaar, Netherlands, email: info@samako.nl) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email).
To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we received the notification of your withdrawal from this contract.
The direct costs of returning the goods shall be borne by the customer.
§ 7 Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery, as well as contracts for the delivery of goods which are, due to their nature, not suitable for return (e.g., hazardous materials, liquids, or gases).
§ 8 Liability for Defects / Warranty
The statutory rights regarding defects according to §§ 434 et seq. BGB apply.
§ 9 Applicable Law and Jurisdiction
(1) The law of the Federal Republic of Germany applies, excluding the UN Sales Convention. For consumers, this only applies insofar as the protection granted by mandatory provisions of the law of the consumer’s habitual residence is not withdrawn.
